By using the DamGoodCompany platform, you confirm that you have read and accepted our Terms and Conditions.  Please read these Terms and Conditions carefully before continuing.

DamGoodCompany is a platform that supplies incredible independent whiskies and craft spirits. We pride ourselves on the safe and responsible operation and selling of alcoholic spirits. Please read our Terms of Service:

By using the DamGoodCompany platform you confirm:

• You can confirm that you are at least 18 years of age or you are the legal drinking age in your country.
• You can guarantee the information you provide to DamGoodCompany is correct. This includes, but it is not limited to payment details, address, name and age. We do not share the information you provide and only use it to fulfil your order.
• When submitting your information, you confirm that you are the person on the billing information

The customer is solely responsible for maintaining the confidentiality of all details submitted to the DamGoodCompany platform. This also means the customer is responsible for anyone else using the details of their account including passwords. If there is any unauthorised activity of the users account they must contact DamGoodCompany immediately.

DamGoodCompany has the right to refuse service, cancel orders and cancel accounts if there is expected misuse.

Users of the platform under the age of 18 should not submit any information or orders to the platform.

General

These Terms and Conditions constitute the entire agreement between you and DamGoodCompany Limited (“we” or “us” or “our”) and govern your use of the website, superseding any prior agreements between you and us with respect to the website.

We are not responsible for any failure or delay to comply with our obligations if the failure or delay is out of our control.

No agent or representative of ours is authorized to make any warranties, representations or statements regarding the products and we shall not in any way be bound by any such unauthorized warranties, representations or statements.

We reserve the right to change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that we shall not be liable for any such change or removal.

We reserve the right to change these Terms and Conditions at any time, and your continued use of the website following any changes shall be deemed to be acceptance of such change.

Disclaimers, Limitation of Liability and Jurisdiction

You hereby expressly state to understand and agree that use of the website is at your sole risk. Neither we, nor our officers, directors, agents, subsidiaries, joint ventures, holding companies, affiliates, employees, third-party content providers, or the like, warrant that the website will be uninterrupted or error-free. We also do not provide any warranty as to the results that may be obtained from direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or any other intangible losses obtained from the use of the website, or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through the website.

The website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

Other than as required under applicable law, under no circumstances will we be liable for any loss or damage caused by your reliance on information obtained through the website or linked sites, or your reliance on any product or service obtained from a linked site. It is your responsibility to evaluate the accuracy, completeness or usefulness of any opinion, advice or other content available through the website, or obtained from a linked site. The website is operated in the United Kingdom. These Terms and Conditions shall be governed by and construed in accordance with the law of the United Kingdom and you hereby submit to the exclusive jurisdiction of the United Kingdom court. If any of these Terms and Conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Confidentiality

We are registered under the Data Protection Act 1998 and as such, any information concerning you and your respective records may be passed to third parties. However, your records are regarded as confidential and therefore will not be divulged to any third party, except if legally required to do so by the appropriate authorities. You have the right to request sight of, and copies of any and all records we keep, on the proviso that we are given reasonable notice of such a request. You are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue you with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

Products

Some of our products are limited editions. This means availability can only last while stocks remain, and availability is subject to change at any time without notice.

Everything is done to be sure that photographs and descriptions of each product are correct. However, errors regarding product information, tasting notes, photos or typographical errors, may occur; please contact us at info@damgoodcompany.com if you feel something is incorrect.

Prices

Everything is done to be sure that prices presented on the website are correct.  However, errors regarding product prices may occur.  If we discover an error in the price of a Product you have ordered we will contact you.  Prices are subject to change at any time without notice.

Email List and Marketing

DamGoodDrams collect email addresses through website sign up forms and marketing promotions through social media such as Instagram, Facebook and LinkedIn. DamGoodDrams use these email lists to send out news on bottlings, giveaways, casks, upcoming events and sales. If you sign up to a DamGoodDrams mailing list you have the right to remove yourself by tapping the UNSUBSCRIBE at the bottom of any of our emails. Taxes, customs and import duties

All alcoholic products we sell are sold subject to UK alcohol tax. 

Your order could be subject to local sales taxes and duties upon arrival in the destination country. All additional charges are the responsibility of the recipient. As customs policies vary widely from country to country, we have no control over these charges, so you should contact your local customs office for further information.

If you refuse to pay any import duties and taxes, this could result in the goods being destroyed by customs or being returned back to us - any refund offered would include a deduction of our costs.

If we are shipping to an address in the U.S. you can read the information provided here by U.S. Customs and Border Protection regarding any queries on importation to the United States.

Age Verification

To let you buy whisky we need to verify your age. Sorry, but it's the law!

Thankfully, we use a system called AgeChecked, which seemlesly works behind the scenes to verify and check your age. 

When you place an order through DamGoodCompany, our platform works in tandem with AgeChecked to verify that you're old enough for a dram! You don't need to do anything.

AgeChecked are an industry-leading service regulated to regulated to BSI: PAS1296.

Confirmation of Order and Invoice

After payment, you will receive via email a confirmation of your order. Should you need to retrieve your invoice, you will be able to view it by logging in at DamGoodCompany.com and select “view your orders/invoices”.
